DineInAmerica.Com reserves the right to provide its services to any party, including those in direct competition with its client. In addition, you acknowledge and agree that DineInAmerica.Com employees and contractors may also be DineInAmerica.Com customers/merchants and that they may compete with you, although they may not use your confidential information in doing so.
DineInAmerica.Com may at any time request documentation proof of identification in order to determine account ownership and use. DineInAmerica.Com may suspend use during such period until a determination can be made as to proper ownership of said account.
You expressly and impliedly acknowledge and agree, the extent permitted by law, that DineInAmerica.Com shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or intangible damages resulting from the use of or inability to use the site. The client acknowledges and affirms that DineInAmerica.Com does not and did not warrant that the results that may be obtained from the use of the Site will be accurate or reliable. Furthermore, it does not warrant that the quality of any products, services, information, or other material purchased or obtained by you through the Site will meet any of your expectations, or that any errors in the Site will be corrected.
This TERMS OF SERVICE represents the entire agreement between DineInAmerica.Com and the client, and supersedes any and all preceding and contemporaneous agreements between DineInAmerica.Com and the client. The failure of DineInAmerica.Com to exercise or enforce any right or provision of the TERMS OF SERVICE shall not constitute a waiver of such right or provision. Any waiver of any provision in this agreement will be effective only if in writing and signed by a duly authorized representative of DineInAmerica.Com.

Such trademarks and other marks, logos, and names of DineInAmerica.Com, used on or in connection with DineInAmerica.Com may not be used in connection with any product or service that is not under DineInAmerica.Com's ownership or control. Furthermore, such trademarks may not be used in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits DineInAmerica.Com. All other trademarks not owned by DineInAmerica.Com (or its affiliates) that appear on the sites are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by DineInAmerica.Com or its affiliates.
